If you are giving it to someone else, that is not BUYING a pre-owned game...
If you buy a pre-owned game from a store then you will only pay for the pre-owned game, you will not need to buy a separate licence for that game...
it amounts to the same for stores that don't/ won't participate in the cloud purchase system. that will also cover disc rentals etc. so it still stands that there
are or could be scenarios in which a fee would be payable. we'll just hae to see what the finally announce

the only 'fact' is that microsoft have yet to finalise/announce how it will work. but it would seem likely that it will depend on how/where you aquire the game
