According to Gamasutra, Bethesda is suing Interplay Entertainment over a breach of contract that took place in April 2007 when Bethesda acquired the rights to the Fallout
In short, Interplay Entertainment has been accused of selling the rights to digital distribution of previous games over such outlets as Steam
, not submitting the advertising and promotional material of previous Fallout
games to Bethesda, and failing to enter full-scale development of the Fallout
MMO prior to the agreed upon deadline.
Bethesda accused Interplay of trademark infringement, two counts of breach of contract, and unfair competition. Bethesda is asking for injunctions against Interplay's manufacture, sale, and distribution of back catalog Fallout games, that a judge declare the trademark licensing agreement terminated, and that Interplay pay for damages and legal fees.
