That's what I did. I've had an XB1 for over 2 years now but still not ready to leave my 360 behind. On the One, Splinter Cell was looking like I might get charged, then later not appearing at all so I started up the 360 and after some incredible waiting time for pages to appear (why is that?), the game was there, available for free. It's ready to install on the One now. I expect they'll fix it properly soon.
