Don't believe what people told you. I've just purchased the game via marketplace website and I already own it on mu Xbox Series X. So yes, it's the same game.

It's a weird situation. I bought Black in like 2011-2012 or something like that, and have the BC version of course. This version shows that I don't own it. Glad it's also giving ppl the BC version, but it's def a different version (Even if it's exactly the same) as the one that used to be on the store.
When original Xbox games became backwards compatible on the Xbox One/Series X|S that were already backwards compatible on the Xbox 360 they relisted the games on the Xbox 360 and delisted the old versions. If you had previously bought a game on Xbox 360 you got the license for the Xbox One/Series X|S version, but not the Xbox 360 version.
For these games there is actually two backwards compatible versions on the Xbox 360. Probably mostly identical, but if you bought the old version before it got delisted and buy the new version you will have two versions on your hard drive and both can be launched and played.
