Absolutely. Much like your Xbox Live purchases on your Xbox 360, your account contains a list of all of the items that have been bought through your account/device. You can head to WindowsPhone.com and log into your Microsoft Live Account to view your history, or simply go to purchase the item again through your phone (the item will read as a previous purchase and prompt you to download again).
It is worth noting that when you uninstall a game from your device, you will lose all data assigned to it, so do not remove a game from your device unless you do not need your progress!

As many members of the TA community will point out, if the price is free and you download it then you know what you are doing is wrong and you are stealing.
As Maesenko stated, bans were only being issued as a result of going against the Xbox ToS Agreement when it comes to region selection. Users should not switched regions for the sake of running into an error.
I am almost positive that at least a few legitimate Windows Phone users who do not consult website such as TrueAchievements will have noticed that these games were free and downloaded them, banning under such circumstances would be unreasonable.
I was able to snag the two Star Wars titles and Rio, but did not get there fast enough to grab Space or Seasons. That's okay though. :)
