Backwards compatible doesn't make it immune to delisting. At the time of making compatible, everything was fine. Publishers cannot produce more copies/downloads to sell if there is content in the game with expired rights (music and trademarks). The game is ten years old so those rights may have lasted only that long. If it is something like music, EA can relist with removed content (like San Andreas has been done by R*). Any new buyers of the game will get a different version but in most cases for old games, it just isn't viable.
Owners of the game still get access to the game to download, be it digital or having a disc inserted.
Also Deadly Premonition has different publishers, so they have their own rights on a region basis. I think there are three backwards compatible versions (US, EU and Red Seeds Profile (JP - shared achievements with EU version).
